Rackemann Attorney Donald Pinto Quoted in June 25, 2012 Massachusetts Lawyer’s Weekly

Don Pinto, a director in the firm’s Litigation Department, was quoted in the June 25, 2012 edition of Lawyer’s Weekly.  Don offered his views on the recent Superior Court decision in 485 Lafayette Street Acquisition, LLC v. Glover Estates, LLC.  In that case, the plaintiff developer attempted to enforce a letter of intent it had signed with the defendant, which was a potential joint venture partner.  The Superior Court ruled that the letter of intent was unenforceable because it didn’t contain all the material terms of the parties’ deal.  Don, who has extensive experience with complex real estate cases, commented that, with decades of case law establishing what’s needed to make a preliminary agreement binding, he continues to be amazed that “parties still march ahead with business deals and invest substantial sums without ensuring that they have an enforceable agreement.”
