May 7, 2009Rackemann, Sawyer and Brewster represented the Liquidator of The Home Insurance Company in this case, which presented an issue of first impression concerning the setoff provision of the New Hampshire Insurer Rehabilitation and Liquidation Act, RSA 402-C:34. We obtained a favorable decision holding that a large setoff asserted by a reinsurer is not permissible under the Act.
