Brian M. Hurley Quoted in The Boston Globe about Chapter 40B Project

Brian M. Hurley, Chair of the Litigation Department, was quoted in The Boston Globe article “Appeal Likely on Housing – Affordable Project Cleared by Court,” on April 4, 2010.  The article describes the recent Appeals Court ruling in favor of a developer represented by Rackemann, Sawyer & Brewster, clearing the way for a new 227-unit residential project to go forward after years of delay.

“Brian Hurley, the attorney representing New Jersey-based Roseland Property, said the company plans to proceed with the project if the town does not file an appeal by the April 8 deadline.  “It’s been a long, hard fight and a very expensive fight.  It started at a time when affordable housing was financeable in Massachusetts, and it’s not particularly financeable now.  But obviously we are very happy and we plan to move forward,” he said.  Hurley said the developer “will cooperate with the town the best we can, and we would be happy to discuss any proposals they might have in mind” that could settle the case.  “But everyone has to keep in mind we are seven years into costs, delays, and legal fees, and that will certainly be a factor in what we are willing to do,” he said.”
