Rich’s practice focuses on real estate development, from site acquisition to permitting, financing and development. For over 20 years, he has advised clients on all aspects of land use law, including zoning, subdivision, wetlands, historic preservation and environmental impact review.
Residential and Retail Development
Rich represents individuals and corporations on real estate projects involving a broad range of land use and development issues. Examples include the following:
Rich represented a national shopping mall developer in connection with the acquisition, re-development and expansion of an existing retail shopping mall in a suburb west of Boston. Rich successfully guided the client through the local, state and federal land use permitting process.
As counsel to a large out-of-state residential apartment developer, Rich advised the client concerning the intricacies of the Chapter 40B housing program, resulting in the approval of over 500 housing units in a project that overlapped municipal boundaries. He is presently representing the same client in connection with a large mixed-use development north of Boston containing over 2,000 housing units, with associated retail, restaurant and hotel uses.
Rich represents several Massachusetts-based developers in connection with age-restricted projects ranging from 22 units to 118 units and single-family subdivisions containing between 8 and 50 lots.
On behalf of the Real Estate Bar Association and the Abstract Club, Rich has prepared and submitted amicus briefs to the Supreme Judicial Court concerning several notable decisions including Massachusetts Broken Stone Company v. Town of Weston, 430 Mass 637 (2000) and Zuckerman v. Town of Hadley, 442 Mass. 511 (2004).
More recently, Rich had advised several individual owners of property on Martha’s Vineyard concerning zoning and wetland permitting as well as regional development constraints, such as the Martha’s Vineyard Commission.
Rich joined Rackemann, Sawyer & Brewster in 1987. Prior to entering law school, he served as Director of the Department of Housing and Urban Development's Community Development Block Grant Program for the Town of Canton, Connecticut.
Community Service Activities
Participant in the pro bono Lawyer for a Day program at the Boston Housing Court, providing advice on landlord/tenant law.
