Practice Focus
Since entering private sector practice in 2002, Brian has provided clients with strategic, technical and regulatory advice in the areas of environmental compliance and enforcement, regulatory agency approvals, and real estate development projects including Brownfield projects. Brian is a well seasoned manager of complex projects and is expert at overseeing and coordinating project teams composed of multi-discipline professionals.
Background
Brian is Vice President of Rackemann Strategic Consulting, Inc., a subsidiary of Rackemann, Sawyer & Brewster, offering strategic and tactical advice on procedural, technical and regulatory issues affecting development projects and environmental permitting.
From 1999 to 2002, Brian was a Director of the Division of Policy and Program Development, Bureau of Waste Site Cleanup at the Massachusetts Department of Environmental Protection in Boston, MA. He was responsible for the identification, design, implementation and management of all planning, policy and regulation development projects governing the assessment and cleanup of release of oil and hazardous material.
From 1997-1999 he was the Branch Chief, Policy and Regulation Development, Bureau of Waste Site Cleanup for the Massachusetts Department of Environmental Protections, Boston, MA. He was responsible for the planning for, development of, and outreach on Bureau policies and regulations governing the assessment and cleanup of releases of oil and hazardous material.
From 1989 to 1997 he was an Environmental Analyst II (1989), III (1990) and IV (1991), for the Bureau of Waste Site Cleanup, Massachusetts Department of Environmental Protection, Boston. As senior policy analyst, his primary responsiblities were in the redesign, implementation, and application of the Massachusetts hazardous waste site cleanup and solid waste programs.
Notable Experience
Brian's clients include both large corporations and small, family-run businesses. Brian is able to meet their specific needs by carefully assessing each case and then developing a strategic approach tailored to site and case-specific circumstances.
- Successfully negotiated and resolved on behalf of clients numerous cases involving allegations of non-compliance. Cases were spread across all of MassDEP's four regional offices and encompassed the requirements for management of asbestos containing materials, hazardous waste storage, collection and disposal, oil and hazardous material notification, assessment, and cleanup, solid waste, air pollution control, wetlands, and stormwater management.
- Negotiated a high profile cleanup case on behalf of the client to settle disputes and break a log jam between client, MassDEP, and the Attorney General's Office concerning proper closure of the site and reimbursement and sharing of cleanup costs.
- Provided technical and regulatory advice to many buyers and sellers of properties where environmental conditions were or were thought to be present.
- Assisted several Massachusetts based industry associations to formulate comments on proposed rule makings and policy initiatives undertaken by regulatory agencies.
- Provided strategic advice to numerous clients on site cleanup requirements and maintaining compliance with site cleanup deadlines while simultaneously meeting development and construction deadlines.
