David Friedman Quoted in Massachusetts Lawyers Weekly

Rackemann family law attorney David Friedman was quoted in the Massachusetts Lawyers Weekly article, “Child support proceeds placed in constructive trust,” which addressed the Worcester Probate Court’s decision in Pawlowski v. Barrera on child support and constructive trust.

In the article, David said the lesson of the case is “that while a promise is a promise, sometimes a promise can also be a trust.” Also, commenting on the judge’s ruling regarding post-minority support, David noted that the judge was bound by the language of the statute. “The statute, as written, results in a child being treated differently because of the child’s living situation…This case brings to light the need for all children to be afforded equal rights to post-majority support regardless of whether they live with a parent, a legal guardian or a third party, particularly when the decision of where and with whom a child lives is often outside a child’s control.”
