Our lawyers regularly represent clients in complex trusts and estate, probate court and other difficult litigation in the state and federal courts of Massachusetts. This experience includes:
- Will Contests/Fiduciary Controversies. Lawyers in the department handle will contests and lawsuits for or against executors and trustees. In addition, we represent fiduciaries in equitable actions, such as trust reformation.
- Family Law Issues. We handle all family law issues that have trust and estate implications, from pre-nuptial agreements to revision of estate plans following divorce or in connection with a client’s child who is divorcing.
- Guardianship and Conservatorships. Our lawyers have experience in obtaining guardianships and conservatorships for individuals who cannot manage their own personal or financial affairs.
- Administrative Proceedings. The firm also represents trustees in probate court proceedings for resignation and appointment of successor trustees and account allowance proceedings, which often include working with court appointed guardians ad litem.
In addition, we help trustees with matters such as exercising discretionary distribution powers.
